Terms and Conditions of Booking

Bookings

It is the responsibility of the customer to ensure that the candidates are able to undertake the training syllabus.  All courses are delivered in English, but with prior notice course material and examinations may be provided in other languages if these are available from the Awarding Body.

First Aid at Work/FAW Requalification/Emergency First Aid at Work/Paediatric First Aid Courses Candidates are required to be physically fit and have the aptitude and ability to cope with an intense course of study and practical activity. They must be willing and able to do all the practical elements of the course.

Highfield/FAIB (First Aid Industry Body) or other Accredited Courses
External awarding body regulations state that the candidate will need to present a form of Photo ID to the Trainer at the start of the course (e.g. Passport, Photo Driving License, Bank Card or Work ID etc.) Failure to do so will mean that the candidate will not be allowed to sit the examination.

Payment

Full payment is due in advance of the course start date unless agreement has previously been made in writing with Albany Training.  Our standard terms mean that payment must be made immediately on receipt of the invoice.  Payment made be made by cheque or by BACS payment direct into the company bank account (preferred method). E-learning links will not be made available until we have received payment in full.

If payment has not been received by the due date, then Albany Training reserve the right not to issue course certificates until payment has been made in full.

Cancellation of courses

Cancellation of courses must be done in writing (email accepted) and be confirmed by Albany Training upon receipt.

The following fees will be due for any cancellations received less than 4 weeks before the course start date.

More than 4 weeks prior to the course – no charge

2 to 4 weeks prior to the course – 50% of the total course fee

Less than 2 weeks prior to the course – full fee will be due.

If unforeseen circumstances require that Albany Training has to cancel a course, then you will be given as much notice as possible (ideally with at least 7 days notice) and offered a free transfer to another course date or a full refund of any  course fee already paid.

Covid-19 Cancellations

If Albany Training are not able to run the course at the published venue due to Government guidelines and restrictions, then we reserve the right to change to another venue which will be in the same locality whenever possible.

Should the Government and/or Awarding Bodies decide that it is unsafe for Albany Training to continue to run courses face-to-face, then the course will be postponed until the restrictions are lifted and it is safe to run again.  The Client will be informed of the next 3 new available dates and will be transferred onto their preferred course at no further cost.  Should the client refuse all 3 available dates then Albany Training reserve the right to cancel the booking with no refund of any payments made.

Transfers to other courses

Should a candidate be unable to attend the course they have been booked on due to reasonable circumstances (this should be confirmed in writing by the booking organisation), then they will be offered a place on the next 2 courses that are due to be held in your area.  Should the candidate decide not to take up the offered places then full fee will be due for that candidate.  This also applies to any funded places – the organisation that booked the course will be invoiced for the non-attending candidate as the funding will no longer be applicable for that candidate on that course.

Substitutions

Substitutions will be accepted as long as they meet the same criteria of the original candidate.  If possible any substitutions should be notified within 4 days prior to the course start date.  If substitutions occur after 4 days then any certificates awarded will be issued after the course end date.

Additional candidates

If any additional candidates attend the course on the course start date without prior notice to Albany Training, then a separate invoice will be raised for these additional candidates, which should be paid immediately upon receipt. Certificates for any additional candidates will not be issued until this invoice has been paid in full.

Non-attendance of candidates

If a candidate does not attend a course and you have not previously informed Albany Training, then the fee for that candidate is still due in full.

Late arrivals or missed sessions

If a candidate arrives late for a course or is absent from any session then Albany Training reserve the right not to issue a certificate on completion of the course.   The course trainer will decide whether that candidate has gained sufficient knowledge from the rest of the course to be awarded the certificate.  If 2/3rds of the course has been attended it may be possible for the candidate to transfer to another course to gain the full qualification or alternatively a lesser qualification may be issued. The trainers’ decision is final.  No refund of course fees will be given for non-completion of a course.

FAW Requalification Course

It is the responsibility of the booking organisation to ensure that the candidates booked on any re-qualification courses still have a valid First Aid at Work certificate showing an expiry date of no less than 28 days later than the last date of the course.  This is an HSE requirement.

Quality

Albany Training will provide trainers suitably qualified and experienced with regard to the course subject and will take all reasonable care to ensure that the presentation and content of the course is made in a professional and competent manner and to a standard appropriate to the course.

Materials and Equipment

All facilities, course materials and equipment will be provided for use by candidates for the duration of the course unless otherwise specified.  Albany Training will not be liable for any materials or equipment brought onto the premises by a candidate.

Copyright of course material

Ownership of and copyright in all course material and documents shall remain with Albany Training.  Candidates may use such material and documents only for their personal use and such material and documents shall not be copied, given, sold assigned or otherwise transferred in whole or in part to any third party without the express written consent of the Albany Training.

Candidates Liability

The Client accepts responsibility in full for the conduct of its candidates whilst on your premises (or premises you have hired for the specific reason of running the course or premises used by Albany Training) and undertakes to indemnify Albany Training against material damage and/or personal injury to the Albany Training, its servants, agents or property as a result of actions or defaults whilst attending the course.

Limit of Liability

Other than liability in respect of death or personal injury, the extent of Albany Training’s liability for any failure to meet its obligation shall be limited to the costs of the course fee only.


Data Protection

Albany Training has a full and complete policy on the way in which it handles any data relating to its’ clients or any candidate who attends a course.  This can be provided upon a written request.

Interpretation

This agreement shall be governed by and construed in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English Courts.

This agreement is subject to the special conditions (if any) contained in the schedule hereto.  In the event of any consistency between such special conditions and the other terms of agreement such special conditions shall prevail.

Force Majeure

Albany Training shall not be liable to refund of fees or for any other penalty should courses be cancelled due to war, fire, strike, lock-out, industrial action, tempest, accident, civil disturbance or any other cause whatsoever beyond their control.

Equal Opportunities Policy

Albany Training has a comprehensive policy and endeavours to meet the requirements of all candidates on all the courses offered.  To enable us to meet those needs please let us know when booking the course, if any candidate has any special needs.  Please note that there will be a separate charge if Albany Training has to provide specialist equipment and/or personnel such as signers or translators.
